Intellectual Property Complaints Policy
In short
- If you believe something on One Poesis infringes your rights or misuses your work, email us with the details listed below.
- We review every complete report. We may disable access to content while we look into it.
- The person whose content is reported can respond. We do not decide who legally owns a work; courts and IP offices do.
- False or bad-faith reports are misuse of this process.
This summary helps you find your way. The full text below is what applies.
1. What this policy covers
Use this policy to report content on One Poesis that you believe:
- infringes your copyright, trademark or other intellectual property rights;
- was uploaded without your permission, or presents your work as someone else's;
- impersonates you or your business;
- otherwise misuses your creative work.
Most content on One Poesis is private to the account that uploaded it. Content can reach other people through share links and through applications filed with a government office. Objections to an application that has been filed or published by an office are handled by that office under its own procedures, such as an opposition with IPOPHL.
To report a privacy concern about your personal information, use the Privacy Notice. To report a security problem, email [email protected].
2. How to report
Email [email protected] with the subject "IP complaint" and include:
- your name and contact details, and if you act for someone else, who and in what capacity;
- the work or right you believe is affected, with a registration number if there is one;
- where the content appears on One Poesis, such as a share link, and what it is;
- why you believe it infringes or misuses your rights;
- a statement that you believe in good faith that the use is not authorised by the rights holder or the law;
- a statement that the information in your report is accurate and that you are the rights holder or authorised to act for them;
- your full name as your signature.
Incomplete reports may take longer, because we may need to ask for more information.
3. What happens next
- We confirm that we received your report and review it.
- Where a report is complete and credible, we may disable a share link, restrict access to the content, or suspend the account involved while we look into it.
- We tell the account holder about the report and the action taken, and share the details they need to respond. This may include your name and the substance of your report, but not your other contact details unless you agree.
- We tell you the outcome.
One Poesis does not decide who legally owns a work or whether a use is lawful. When the facts are disputed, we act on the information available and may leave the matter to the parties, the courts or the relevant IP office.
4. If your content was reported
If you believe a report about your content is mistaken, reply to our notice or email [email protected] explaining why, with any evidence such as licences, earlier records or registrations, and a statement that the information is accurate. We will consider your response and may restore access. We may share your response with the person who reported.
5. Repeat infringement
We may close the accounts of people who repeatedly upload content that infringes others' rights, or who file applications in bad faith.
6. Misuse of this process
Do not send reports you know are false, or use this process to harass someone or to gain an advantage in a business dispute. We may ignore such reports and take action against accounts that send them. Knowingly false statements may also have legal consequences.
7. Misuse of your work outside One Poesis
If your work is being misused elsewhere, One Poesis can help you organise your records and evidence. We do not take enforcement action on your behalf, and we recommend speaking to a qualified IP professional about your options.
